Garage Dubern —Terms and Conditions
Effective date:10/01/2023
Service provider: Garage Dubern
Business address: 12 rue clement dessout
1. Application of these terms
These terms apply to remote services supplied by Garage Dubern. “Customer” means the person or business ordering the work.
We will make these terms available before work begins. Acceptance of our quotation or express authorisation to start a session confirms your agreement to them. Any specifically agreed written service conditions take priority where they conflict with these terms.
2. Services and coverage
Garage Dubern offers remote vehicle programming, coding and diagnostic assistance through compatible equipment, including iSCAN and Autel interfaces.
Each booking covers the agreed vehicle and operation only. Additional work requires separate approval. Compatibility must be confirmed before the session.
Diagnostic findings reflect the information available at the time. Clearing fault codes does not establish that an underlying fault has been repaired.
3. Authority to request work
You must own the vehicle or have the owner’s permission to authorise the requested work.
Where you act for a workshop, fleet or other business, you confirm that you can approve the work and associated charges on its behalf. We may request evidence of authority before accepting security-related operations.
You must provide accurate vehicle details and disclose relevant repairs, modifications, previous programming attempts and known faults.
4. Customer preparation and responsibilities
Provide reliable internet, a compatible interface and a suitable programming power supply. A competent technician must remain available at the vehicle and follow the agreed instructions.
Keep people clear of moving components during remote operation. Do not interrupt power, disconnect equipment or operate vehicle controls unless instructed.
Your workshop remains responsible for physical inspections, installation work, electrical testing and vehicle safety. Remote assistance does not replace an inspection of conditions that cannot be assessed through the connection.
Hybrid and electric vehicle work must be handled by appropriately trained personnel using suitable protective equipment and manufacturer procedures.
5. Session arrangements
Appointments are confirmed individually. Estimated completion times may change if unexpected faults or access difficulties arise.
Tell us promptly if the vehicle or equipment will not be ready. We may pause or decline work where preparation is inadequate, the requested operation is unsuitable or continuing would create an unacceptable risk.
Any cancellation, waiting-time or additional attendance charge must be disclosed and agreed before it applies.
6. Prices and payment
We will confirm the agreed charges before starting. Additional investigation, repeat attendance or recovery work requires approval.
The quotation or invoice will identify the currency, applicable taxes, payment method and payment deadline. Third-party access or software charges must also be disclosed.
A session may identify a separate repair requirement without resolving the original concern. Any charge for investigation or an unsuccessful attempt must be explained before authorisation. An unsuccessful outcome alone does not determine whether a refund is due.
7. Interruptions and recovery
If programming fails or the vehicle becomes inoperable, notify us immediately and preserve the equipment connection where safe.
Recovery options and any extra charges will be assessed before further work is authorised. Responsibility will depend on the circumstances, including equipment condition, instructions followed and the work performed.
Neither party accepts responsibility for a failure merely by assisting with recovery.
8. Completion and vehicle release
Your technician must complete the necessary physical checks, calibrations and road testing before releasing the vehicle.
Tell us promptly about any concern relating to our work and provide relevant reports or fault records. Where practical, allow us an opportunity to investigate before further programming changes the vehicle’s condition.
This does not prevent urgent action needed to protect people or property.
9. Third-party systems and manufacturer affiliation
Manufacturer systems, software availability and third-party platform access may affect whether an operation can proceed. We will explain any material limitation identified during the job.
Garage Dubern is an independent service provider. References to vehicle manufacturers, iSCAN, Autel or other brands identify relevant equipment and services and do not imply manufacturer endorsement or affiliation.
10. Standard of service and liability
Garage Dubern will perform the agreed services with reasonable care and skill. A particular repair outcome cannot be promised where it depends on faults, components or circumstances beyond the agreed work.
To the extent permitted by applicable law, Garage Dubern excludes liability for indirect or consequential business losses, including lost profits or business interruption.
These terms do not exclude liability for fraud, deliberate wrongdoing, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. They do not remove mandatory consumer rights.
Customer responsibility for equipment or vehicle preparation does not excuse a failure by Garage Dubern to exercise reasonable care and skill.
11. Remote access and information
Authorisation to begin a session permits the remote access reasonably needed for the agreed task. Access to unrelated systems or information is outside that authorisation.
Vehicle information, diagnostic records and necessary contact details may be used to deliver the service, investigate concerns and maintain required business records. Personal information must be handled in accordance with applicable data-protection requirements.
12. Changes, complaints and governing law
Updated terms apply to future bookings after they have been made available. Changes to an existing authorised job require agreement.
Please contact Garage Dubern first so that any service concern can be investigated.
